These Terms of Service govern your access to and use of Gordon, including the website located at usegordon.com, the Gordon customer dashboard, article-generation features, website-research features, WordPress publishing tools, automatic schedules, the Article Grader, and all other services provided by Gordon.
In these Terms of Service, “Gordon,” “we,” “us,” and “our” refer to the Gordon service available through usegordon.com. “You” and “your” refer to the person, business, or organization accessing or using Gordon.
Please read these Terms of Service carefully. By creating an account, purchasing a subscription, connecting a website, using the Article Grader, generating content, publishing an article, or otherwise using Gordon, you agree to these Terms of Service.
If you do not agree to these Terms of Service, you must not use Gordon.
1. About Gordon
Gordon is an AI-powered article-writing and content-management service designed primarily for businesses.
Depending on the features and plan available to you, Gordon may allow you to:
- Create and manage a business profile.
- Provide information about your business, services, products, programs, audiences, locations, and service areas.
- Allow Gordon to research publicly available pages on your business website.
- Generate article ideas.
- Generate articles and article metadata.
- Generate featured images and image alt text.
- Review, edit, refine, save, schedule, and publish articles.
- Connect a WordPress website through the WordPress REST API.
- Save articles as WordPress drafts.
- Publish articles immediately.
- Schedule articles for future publication.
- Create automatic article-generation and publishing schedules.
- Grade publicly available articles using the Article Grader.
- Receive recommendations related to article quality, structure, readability, search intent, SEO, GEO, AEO, and publish readiness.
- Manage subscriptions, allowances, businesses, and account preferences.
Features may vary depending on your plan, account status, location, website configuration, and the current version of Gordon.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use Gordon.
By using Gordon, you confirm that:
- You are at least 18 years old.
- The information you provide is accurate and complete.
- You have the authority to enter into these Terms of Service.
- Your use of Gordon will comply with applicable laws and regulations.
If you use Gordon on behalf of a business, company, partnership, nonprofit organization, agency, client, or other entity, you confirm that you have authority to accept these Terms of Service on that entity’s behalf.
In that situation, “you” includes both you and the entity you represent.
3. Your Gordon Account
Some Gordon features require an account.
You agree to:
- Provide accurate and current account information.
- Maintain the accuracy of your account information.
- Use a strong and unique password.
- Keep your password and account credentials confidential.
- Prevent unauthorized access to your account.
- Notify Gordon promptly if you suspect unauthorized access or misuse.
- Accept responsibility for activity performed through your account unless caused directly by Gordon’s failure to use reasonable security safeguards.
You must not:
- Create an account using false or misleading information.
- Impersonate another person or business.
- Share your account with unauthorized individuals.
- Sell, transfer, rent, or sublicense your account.
- Use another person’s account without permission.
- create multiple accounts to avoid plan limits, usage limits, suspensions, or restrictions.
You are responsible for ensuring that anyone you authorize to access your account complies with these Terms of Service.
Gordon may require you to verify your email address, identity, account ownership, business relationship, or authority to connect a website.
4. Business Profiles
Gordon may allow you to create one or more business profiles, depending on your plan.
A business profile may contain information such as:
- Business name.
- Website address.
- Business description.
- Services, products, programs, or offerings.
- Locations and service areas.
- Intended audiences.
- Writing preferences.
- Calls to action.
- Contact information.
- Internal links.
- Publishing preferences.
- WordPress categories and tags.
- Featured-image preferences.
- Additional instructions or business context.
You are responsible for ensuring that business-profile information is accurate, current, lawful, and appropriate for use in generated content.
Gordon may rely on the information in your business profile when generating articles, ideas, images, metadata, calls to action, or publishing instructions.
You must review and update your business profile when your services, locations, contact information, policies, pricing, or other important business details change.
Gordon is not responsible for inaccurate or outdated content caused by inaccurate or outdated information in your business profile.
5. Website Research
Gordon may access and review publicly available pages from a website address you provide.
By submitting a website address, you confirm that:
- You own the website, manage the website, represent the business associated with it, or are otherwise authorized to use its information.
- Gordon may access publicly available pages for the purpose of providing the Service.
- Your request does not require Gordon to bypass passwords, access controls, paywalls, robots restrictions, or technical security measures.
- The website does not contain information you are prohibited from providing to Gordon.
Gordon may extract or process publicly available information such as:
- Business descriptions.
- Services and products.
- Programs and offerings.
- Locations and service areas.
- Contact information.
- Staff information.
- Internal links.
- Calls to action.
- Page titles and headings.
- Publicly displayed text and images.
- Other information relevant to understanding the business or creating content.
Gordon may limit the number of pages reviewed and may decline to access pages, websites, file types, redirects, domains, or content that present technical, legal, security, privacy, or operational concerns.
Website research may be incomplete. Gordon does not guarantee that it will discover every relevant page or correctly interpret every detail.
You are responsible for reviewing the information Gordon discovers before using it in an article.
6. WordPress Connections
Gordon may allow you to connect a WordPress website through the WordPress REST API.
To connect a WordPress website, you may be asked to provide:
- The website address.
- A WordPress username.
- A WordPress application password.
- Publishing preferences.
- Category and tag selections.
Gordon does not require your regular WordPress account password.
By connecting a WordPress website, you confirm that:
- You own or are authorized to manage the website.
- You are authorized to create, edit, schedule, upload, or publish content on the website.
- The WordPress user and application password belong to you or were provided with permission.
- Gordon may interact with the WordPress REST API according to your instructions.
- Gordon may retrieve categories, tags, media information, post information, and technical responses needed to operate the connection.
- Gordon may upload images and create, edit, schedule, or publish posts when you request or authorize those actions.
You should use a dedicated WordPress user with only the permissions Gordon reasonably requires.
You are responsible for:
- Choosing the WordPress permissions assigned to the connected user.
- Maintaining the security of your WordPress website.
- Maintaining appropriate website backups.
- Keeping WordPress, themes, and plugins updated.
- Reviewing who has access to your Gordon and WordPress accounts.
- Revoking application passwords that are no longer required.
- Confirming that content appears correctly after it is sent to WordPress.
Gordon encrypts saved WordPress application passwords. However, no storage or transmission method is completely secure.
You can revoke a WordPress application password through your WordPress user profile. Revoking the password may immediately prevent Gordon from accessing or publishing to the website.
Gordon is not responsible for:
- WordPress outages.
- Hosting outages.
- Plugin or theme conflicts.
- REST API restrictions.
- Security plugins that block Gordon.
- Changes made by WordPress or a hosting provider.
- Changes to WordPress permissions.
- Website malware or unauthorized access.
- Deleted categories, tags, media, or posts.
- Formatting changes caused by a theme or plugin.
- Failed publications caused by the website or hosting environment.
- Losses caused by inadequate website backups.
7. Article Generation
Gordon uses artificial intelligence and information provided or authorized by you to generate content.
Generated content may include:
- Article ideas.
- Article titles.
- Article drafts.
- Headings.
- Paragraphs.
- Lists.
- Frequently asked questions.
- Calls to action.
- Excerpts.
- Meta descriptions.
- URL slugs.
- Keywords.
- Internal links.
- Source summaries.
- Featured-image prompts.
- Generated images.
- Image alt text.
- Article grades.
- Recommendations.
- Other related content.
You understand that artificial intelligence is probabilistic. Gordon may generate content that is inaccurate, incomplete, outdated, repetitive, inappropriate, or unsuitable for your business.
You are responsible for reviewing all generated content before using, distributing, scheduling, or publishing it.
Your review should include confirming:
- Business information.
- Services and products.
- Locations and service areas.
- Contact details.
- Prices and offers.
- Dates and availability.
- Policies and procedures.
- Industry-specific claims.
- Health, legal, financial, or safety information.
- Testimonials or statements about other people.
- Copyright and trademark issues.
- Internal and external links.
- Calls to action.
- Image details and image alt text.
- Compliance with advertising and industry rules.
Gordon is a writing and publishing tool. Gordon is not the final authority on your business, industry, customers, or legal obligations.
8. No Guarantee of Search Results
Gordon may structure content using practices intended to improve clarity for readers, search engines, and AI platforms.
However, Gordon does not guarantee:
- Search-engine rankings.
- Website traffic.
- Leads.
- Sales.
- Conversions.
- Revenue.
- Backlinks.
- Search-engine indexing.
- Inclusion in AI-generated answers.
- Citations from AI platforms.
- Featured snippets.
- Local search visibility.
- A particular SEO, GEO, or AEO result.
- Approval by any search engine, platform, advertiser, or marketplace.
Search performance depends on many factors outside Gordon’s control, including your website, competition, domain authority, technical performance, reputation, content history, backlinks, location, search-engine algorithms, and overall marketing strategy.
Search engines and AI platforms may change their systems at any time.
9. Article Grader
Gordon may provide a free or paid Article Grader that reviews publicly available article pages.
The Article Grader may assess areas such as:
- Topic clarity.
- Search intent.
- Structure.
- Heading use.
- Information quality.
- Readability.
- Originality.
- Trustworthiness.
- SEO.
- GEO.
- AEO.
- Internal-link opportunities.
- Repetition.
- Local relevance.
- Publish readiness.
Article grades and recommendations are automated assessments. They are opinions generated using Gordon’s current evaluation methods and should not be treated as guarantees or definitive professional audits.
A high grade does not guarantee search performance, accuracy, originality, legal compliance, or business results. A low grade does not necessarily mean an article is ineffective or unsuitable.
You may submit only article addresses that:
- Are publicly accessible.
- You may lawfully access.
- Do not require Gordon to bypass access controls.
- Do not contain content you are prohibited from submitting.
Gordon may apply usage limits, IP-based limits, account limits, request limits, or other restrictions to prevent abuse.
10. Automatic Schedules and Publishing
Gordon may allow you to schedule individual articles or create automatic article-generation and publishing schedules.
When you create or enable a schedule, you authorize Gordon to perform the selected actions according to your settings.
Depending on your selections, Gordon may:
- Generate an article idea.
- Generate an article.
- Generate a featured image.
- Save an article in Gordon.
- Send an article to WordPress.
- Save an article as a WordPress draft.
- Schedule a WordPress post.
- Publish a WordPress post.
- Apply a selected category or tag.
- Select a publication date and time using the schedule rules you configure.
You are responsible for reviewing:
- The selected business.
- The connected website.
- The schedule frequency.
- The start date.
- The publication time.
- Any date or time variation settings.
- The WordPress category and tags.
- The publishing status.
- The content instructions.
- The timezone associated with the schedule.
If you authorize automatic publishing, content may be published without an additional approval step.
You should use draft or review settings rather than automatic publishing when a topic requires human verification.
Scheduled actions may occur later than expected because of server timing, website availability, connection failures, queue processing, maintenance, timezones, daylight-saving changes, WordPress cron behaviour, or other technical factors.
Gordon does not guarantee that a scheduled action will occur at an exact second or minute.
You may pause, modify, or delete a schedule through the available account controls. Changes may not stop an action that has already begun processing.
11. Your Content
“Your Content” includes information, text, images, instructions, website addresses, business details, files, edits, prompts, feedback, and other materials you submit to Gordon.
You retain ownership of Your Content.
You grant Gordon a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, format, transmit, and use Your Content only as reasonably necessary to:
- Provide the Service.
- Generate requested content.
- Research authorized websites.
- Save your account information and drafts.
- Connect with your WordPress website.
- Process publishing instructions.
- Provide support.
- Maintain security.
- Prevent fraud and abuse.
- Troubleshoot errors.
- Comply with legal obligations.
This licence ends when Your Content is deleted from Gordon’s active systems, except where temporary retention is required for backups, security, legal compliance, dispute resolution, or other purposes described in Gordon’s Privacy Policy.
Gordon does not use Your Content to train a Gordon-owned, general-purpose artificial intelligence model.
You confirm that:
- You own Your Content or have permission to use it.
- Your Content does not violate another person’s rights.
- Your Content does not contain unlawful material.
- You have obtained any required permissions or consents.
- Gordon’s processing of Your Content as described in these Terms will not violate applicable law or an agreement with another person.
12. Ownership of Generated Content
“Generated Content” means articles, article ideas, images, metadata, recommendations, grades, and other outputs Gordon generates specifically in response to your use of the Service.
As between you and Gordon, and to the extent permitted by applicable law, you may use, edit, publish, reproduce, distribute, and commercialize Generated Content created for your account.
To the extent Gordon holds any transferable rights in Generated Content created specifically for you, Gordon assigns those rights to you after any applicable payment has been received.
This does not transfer ownership of:
- Gordon’s software.
- Gordon’s website.
- Gordon’s brand.
- Gordon’s name or characters.
- Gordon’s logos.
- Gordon’s interface.
- Gordon’s prompts and internal instructions.
- Gordon’s scoring systems.
- Gordon’s templates.
- Gordon’s databases.
- Gordon’s research methods.
- Gordon’s publishing systems.
- Gordon’s proprietary technology.
- Third-party technology or content.
Generated Content may not be unique. Other users may receive content, wording, ideas, structures, images, or recommendations that are similar to yours.
Gordon does not guarantee that Generated Content is eligible for copyright, trademark, patent, or other intellectual-property protection.
You are responsible for determining whether Generated Content can be lawfully used and whether any additional clearance, permission, disclosure, or attribution is required.
13. Gordon’s Intellectual Property
Gordon and its licensors retain all rights in the Service, including:
- Software.
- Source code.
- Object code.
- Algorithms.
- Workflows.
- Prompts.
- Templates.
- Scoring methods.
- Databases.
- Designs.
- Graphics.
- Characters.
- Illustrations.
- Branding.
- Logos.
- Audio.
- Text.
- Documentation.
- Website content.
- Product names.
- Domain names.
- Trade secrets.
- Other proprietary materials.
Gordon grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Service in accordance with your plan and these Terms of Service.
You must not:
- Copy or reproduce Gordon’s software or interface.
- Reverse engineer or attempt to discover source code.
- Extract Gordon’s prompts, system instructions, scoring systems, or internal methods.
- Create a competing product using Gordon’s protected technology or confidential information.
- Remove copyright, trademark, or ownership notices.
- Use Gordon’s name, logo, character, or branding without written permission.
- Frame or mirror the Gordon website.
- Sell, sublicense, rent, or provide unauthorized access to the Service.
- Use automated systems to scrape or extract Gordon’s protected content.
No rights are granted except those expressly stated in these Terms.
14. Feedback
You may voluntarily provide suggestions, ideas, reviews, feature requests, or other feedback about Gordon.
You grant Gordon a perpetual, worldwide, royalty-free right to use, modify, publish, and incorporate that feedback into Gordon without compensation or obligation to you.
This does not give Gordon ownership of your confidential business information or Your Content.
15. Acceptable Use
You may use Gordon only for lawful purposes.
You must not use Gordon to:
- Violate any law or regulation.
- Infringe copyright, trademark, privacy, publicity, contractual, or other rights.
- Publish content you know is false, fraudulent, or materially misleading.
- Impersonate another person, business, professional, or organization.
- Create fake testimonials, reviews, endorsements, qualifications, or credentials.
- Defame, harass, threaten, exploit, or unlawfully discriminate against another person.
- Generate or distribute spam.
- Send unsolicited commercial messages in violation of applicable law.
- Distribute malware, viruses, ransomware, or harmful code.
- Conduct phishing, credential theft, fraud, or identity theft.
- Circumvent security measures, request limits, or plan limits.
- Probe, scan, or test Gordon’s systems without written authorization.
- Interfere with Gordon’s operation or another user’s access.
- Overload Gordon’s infrastructure through excessive automated requests.
- Use unauthorized bots, crawlers, scrapers, or automated systems.
- Resell Gordon accounts or access without written permission.
- Submit confidential or personal information you are not authorized to use.
- Bypass website passwords, paywalls, robots restrictions, or access controls.
- Connect a WordPress website without authorization.
- Publish to a website without authorization.
- Use Generated Content to make deceptive professional, medical, legal, financial, safety, or government claims.
- Represent Generated Content as independently verified when it has not been reviewed.
Gordon may investigate suspected misuse and may limit, suspend, or terminate access where reasonably necessary to protect Gordon, its users, service providers, websites, or the public.
16. Professional and Regulated Content
Gordon is not a law firm, accounting firm, medical provider, financial adviser, tax adviser, engineering firm, or other regulated professional service.
Generated Content is not a substitute for professional advice.
If you use Gordon for content involving legal, medical, financial, tax, safety, engineering, insurance, employment, educational, or other regulated matters, you are responsible for obtaining review from a qualified professional where appropriate.
You must not rely on Gordon to make decisions involving:
- Medical diagnosis or treatment.
- Legal rights or obligations.
- Investments or financial products.
- Lending or credit.
- Insurance eligibility.
- Employment eligibility.
- Educational admissions.
- Housing eligibility.
- Government benefits.
- Emergency or safety instructions.
- Other decisions that may significantly affect a person’s rights or wellbeing.
17. Subscription Plans
Gordon may offer free and paid plans.
Plan features may include limits relating to:
- Number of businesses.
- Number of articles.
- Number of generated images.
- Number of schedules.
- Number of connected websites.
- Article-generation frequency.
- Publishing features.
- Support access.
- Other usage allowances.
The features, prices, billing periods, and limits displayed during signup, checkout, or in your account form part of your subscription agreement.
Gordon may offer trials, free articles, promotional allowances, discounts, coupons, bonus articles, or limited-time features.
Promotions may:
- Be limited to certain users.
- Expire.
- Be changed or withdrawn.
- Be restricted to one account, customer, business, or payment method.
- Have additional terms disclosed when offered.
Unused monthly or periodic allowances do not carry forward unless your plan expressly states otherwise.
Allowances have no cash value and cannot be transferred, resold, or exchanged for money.
18. Billing and Automatic Renewal
Paid subscriptions are billed in advance according to the billing period displayed at checkout.
By purchasing a recurring subscription, you authorize Gordon and its payment provider to charge your selected payment method:
- When you first subscribe.
- On each renewal date.
- For applicable taxes.
- For plan changes or additional purchases you approve.
- For other charges clearly disclosed and authorized by you.
Your subscription will renew automatically until you cancel it.
The subscription price, billing frequency, and renewal information will be displayed during checkout or in your account.
You are responsible for:
- Providing accurate billing information.
- Keeping your payment method current.
- Paying applicable fees and taxes.
- Reviewing your renewal date.
- Cancelling before renewal if you do not want another billing period.
Prices are displayed in the currency shown during checkout. Applicable government-imposed taxes may be added.
Gordon will not add undisclosed mandatory non-government fees to the advertised subscription price.
19. Failed Payments
If a payment fails, Gordon or its payment provider may:
- Retry the payment.
- Ask you to update your payment method.
- Restrict paid features.
- Pause article generation.
- Pause schedules or publishing actions.
- Suspend the subscription.
- Cancel the subscription after reasonable payment attempts.
You remain responsible for amounts properly charged before cancellation or suspension.
Gordon is not responsible for losses caused by a schedule, generation, or publication being paused because of an unpaid subscription.
20. Plan Changes and Price Changes
You may be able to upgrade or downgrade your plan through your account.
The timing and effect of a plan change may be shown before you confirm the change.
An upgrade may take effect immediately and may result in a prorated or immediate charge.
A downgrade may take effect immediately or at the end of the current billing period, depending on the option presented when you make the change.
Downgrading may reduce:
- Business allowances.
- Article allowances.
- Schedule access.
- Publishing features.
- Storage.
- Other plan features.
You are responsible for reviewing the effect of a downgrade before confirming it.
Gordon may change subscription prices or plan features. Price changes will not retroactively change a billing period that has already been paid.
Where reasonably practical, Gordon will provide advance notice of a material price increase affecting an existing recurring subscription. The new price will apply to a future renewal after the effective date stated in the notice.
You may cancel before the new price takes effect.
21. Cancellation
You may cancel a recurring Gordon subscription through the cancellation controls available in your account.
You may also request cancellation by emailing hello@usegordon.com from the email address associated with your account.
Use the subject line “Subscription Cancellation.”
To avoid an upcoming renewal, you must submit the cancellation before the renewal payment is processed.
Unless otherwise stated during cancellation:
- Cancellation stops future renewals.
- Your paid plan remains active until the end of the billing period already paid.
- You will not be charged for another billing period after cancellation takes effect.
- Unused articles, credits, allowances, or features expire when the paid plan ends.
- Cancellation does not automatically delete your Gordon account.
- Cancellation does not delete articles already published to WordPress.
You are responsible for exporting, publishing, copying, or saving any content you wish to retain before your account access or plan features end.
22. Refunds
Except where required by law or expressly stated in a written Gordon refund offer, payments are non-refundable.
Gordon does not normally provide refunds or credits for:
- Partial billing periods.
- Unused article allowances.
- Unused businesses.
- Unused schedules.
- Failure to cancel before renewal.
- A change of mind.
- Dissatisfaction with an article after it has been generated.
- Search results that do not meet your expectations.
- WordPress, hosting, plugin, theme, or third-party failures.
- Account suspension caused by a violation of these Terms.
- Time remaining after you choose to stop using Gordon.
If you believe you were charged incorrectly, email hello@usegordon.com promptly with the subject line “Billing Question.”
Nothing in this section limits any refund, cancellation, or consumer right that cannot legally be excluded.
23. Taxes
You are responsible for applicable sales, use, value-added, goods and services, harmonized sales, withholding, or similar taxes associated with your purchase, except taxes based on Gordon’s net income.
Where Gordon is required to collect tax, the tax may be added during checkout or billing.
You are responsible for providing accurate location, billing, and tax information.
24. Third-Party Services
Gordon relies on or connects with third-party services, which may include:
- WordPress.
- Website-hosting providers.
- Payment processors.
- WooCommerce and subscription systems.
- Artificial-intelligence providers.
- Image-generation providers.
- Email-delivery providers.
- Security services.
- Analytics and performance services.
- Domain and content-delivery services.
- Other infrastructure providers.
Your use of a third-party service may be governed by that provider’s terms and privacy policy.
Gordon does not control and is not responsible for:
- A third party’s availability.
- A third party’s security.
- A third party’s policies.
- A third party’s pricing.
- A third party’s data practices.
- A third party’s changes or discontinuation.
- Content or actions taken by a third party.
- Losses caused by a third-party service.
Gordon may change service providers or integrations without notice when reasonably necessary to operate, secure, or improve the Service.
25. Service Availability
Gordon aims to provide a reliable service, but uninterrupted availability is not guaranteed.
The Service may be temporarily unavailable because of:
- Maintenance.
- Updates.
- Security work.
- Server failures.
- Hosting problems.
- Internet outages.
- Third-party outages.
- WordPress problems.
- Payment-provider issues.
- AI-provider limits or outages.
- Unusually high demand.
- Legal or regulatory requirements.
- Events outside Gordon’s reasonable control.
Gordon may introduce usage limits, queues, rate limits, temporary restrictions, or other controls to maintain reliability and prevent abuse.
Gordon is not responsible for delays caused by matters outside its reasonable control.
26. Changes to the Service
Gordon may add, change, improve, replace, limit, or remove features.
This may include changes to:
- Article-generation methods.
- Article prompts.
- Scoring methods.
- Website-research methods.
- WordPress integrations.
- Image-generation systems.
- Plan allowances.
- Dashboard design.
- Scheduling options.
- Supported websites or file types.
- Third-party providers.
Where reasonably practical, Gordon will provide notice before removing a material paid feature from an existing plan.
Gordon may make immediate changes without advance notice where necessary for security, legal compliance, fraud prevention, third-party service changes, or system stability.
27. Beta and Experimental Features
Gordon may make beta, preview, test, or experimental features available.
These features may:
- Be incomplete.
- Contain errors.
- Change without notice.
- Be unavailable at times.
- Produce unexpected results.
- Be discontinued.
- Have separate limits or conditions.
You use beta and experimental features at your own discretion.
28. Privacy
Gordon’s collection, use, storage, and disclosure of personal information are described in Gordon’s Privacy Policy.
The Privacy Policy forms part of these Terms of Service.
By using Gordon, you acknowledge that information may be processed by Gordon and its service providers as described in the Privacy Policy.
29. Copyright and Intellectual-Property Complaints
Gordon respects intellectual-property rights.
If you believe content stored or generated through Gordon infringes your copyright, trademark, or other intellectual-property rights, email:
Use the subject line “Intellectual Property Complaint.”
Your notice should include:
- Your name and contact information.
- Identification of the protected work or right.
- Identification of the content you believe is infringing.
- Enough information for Gordon to locate the content.
- An explanation of why you believe the use is unauthorized.
- A statement that the information in your notice is accurate.
- Confirmation that you are the rights holder or authorized to act for the rights holder.
Gordon may request additional information, remove or restrict content, notify the account holder, or take other action considered appropriate.
Submitting a knowingly false complaint may expose you to legal liability.
30. Suspension and Termination by Gordon
Gordon may limit, suspend, or terminate your account or access if Gordon reasonably believes that:
- You violated these Terms.
- You failed to pay required fees.
- Your payment activity appears fraudulent.
- Your account has been compromised.
- Your use creates a security or legal risk.
- Your use may harm Gordon, another user, a website, a service provider, or the public.
- You attempted to bypass usage limits.
- You used Gordon for prohibited activity.
- Gordon is required to do so by law.
- Continuing to provide the Service is no longer technically or commercially practical.
Where appropriate, Gordon may provide notice and an opportunity to correct the issue before termination.
Gordon may suspend access immediately where necessary to protect security, prevent fraud, stop unlawful activity, or avoid harm.
Termination does not entitle you to a refund where the termination resulted from your material breach of these Terms.
31. Closing Your Account
You may request account closure by emailing:

The request must be sent from the email address associated with the account.
Before requesting closure, you should:
- Cancel any active subscription.
- Export or copy articles you wish to retain.
- Review active schedules.
- Disconnect WordPress websites.
- Revoke WordPress application passwords where appropriate.
- Confirm that scheduled posts are handled as intended.
Closing your Gordon account does not:
- Delete articles already published to WordPress.
- Cancel obligations incurred before closure.
- Require Gordon to delete records that must be retained for legal, tax, accounting, fraud-prevention, security, or dispute-resolution purposes.
- Immediately remove temporary copies from backups.
Account information will be handled according to Gordon’s Privacy Policy.
32. Effect of Termination
When your account or access ends:
- Your right to use Gordon ends.
- Active schedules may stop.
- WordPress connections may stop functioning.
- Unused allowances may expire.
- You may lose access to stored articles, ideas, images, and settings.
- Outstanding payment obligations remain due.
- Provisions intended to survive termination remain effective.
Sections relating to ownership, intellectual property, payment obligations, disclaimers, limitation of liability, indemnification, disputes, and other provisions that logically should survive will remain in effect.
33. Disclaimer of Warranties
Gordon aims to provide a useful and reliable service. However, artificial intelligence, website research, WordPress connections, and third-party systems may produce errors or unexpected results.
To the maximum extent permitted by law, Gordon is provided on an “as is” and “as available” basis.
Gordon does not make warranties or guarantees that:
- The Service will always be available.
- The Service will be uninterrupted or error-free.
- Every error will be corrected.
- Generated Content will be accurate.
- Generated Content will be complete or current.
- Generated Content will be unique.
- Generated Content will not resemble third-party content.
- Generated Content will be suitable for a particular purpose.
- Generated Content will comply with every law or industry rule.
- Website research will find every relevant page.
- WordPress publishing will always succeed.
- Scheduled actions will occur at an exact time.
- Generated images will accurately depict all requested details.
- The Article Grader will match another tool’s assessment.
- The Service will produce search rankings, traffic, leads, sales, or revenue.
- The Service will meet every user’s requirements.
To the maximum extent permitted by law, Gordon disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and satisfactory quality.
Nothing in these Terms excludes a warranty or legal right that cannot lawfully be excluded.
34. Limitation of Liability
To the maximum extent permitted by law, Gordon will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages.
This includes losses relating to:
- Lost profits.
- Lost revenue.
- Lost business opportunities.
- Lost customers.
- Lost data.
- Lost content.
- Lost search rankings.
- Lost website traffic.
- Reputational harm.
- Business interruption.
- Website downtime.
- Failed publications.
- Incorrect publications.
- Delayed publications.
- WordPress errors.
- Hosting errors.
- Third-party service failures.
- Reliance on Generated Content.
- Failure to review Generated Content.
- Unauthorized account access not caused by Gordon’s failure to use reasonable safeguards.
To the maximum extent permitted by law, Gordon’s total liability for all claims arising from or relating to the Service or these Terms will not exceed the greater of:
- The amount you paid to Gordon during the six months immediately before the event giving rise to the claim; or
- $100 Canadian.
These limitations apply regardless of the legal theory of the claim and even if Gordon was advised that a loss was possible.
These limitations do not apply to liability arising from Gordon’s fraud, wilful misconduct, or another liability that cannot legally be limited or excluded.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, the limitations apply only to the maximum extent permitted by law.
35. Your Responsibility for Published Content
You are the publisher of content you choose or authorize Gordon to send to your website.
You are responsible for:
- Reviewing the content.
- Approving its publication.
- Correcting inaccuracies.
- Maintaining required disclosures.
- Complying with advertising rules.
- Complying with professional and industry requirements.
- Responding to complaints.
- Removing outdated content.
- Protecting personal and confidential information.
- Ensuring you have rights to use names, trademarks, images, and other materials.
Gordon is not the publisher, editor, owner, operator, or administrator of your WordPress website merely because Gordon generated or transmitted content to it.
36. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold Gordon and its service providers, contractors, representatives, and personnel harmless from third-party claims, losses, liabilities, damages, judgments, penalties, and reasonable legal expenses arising from:
- Your Content.
- Your business profile.
- Your website.
- Your use of Generated Content.
- Content you publish or authorize Gordon to publish.
- Your violation of these Terms.
- Your violation of applicable law.
- Your violation of another person’s rights.
- Your unauthorized connection to a website.
- Your failure to obtain required permissions or consents.
- A claim relating to your products, services, business, or published statements.
Gordon will provide reasonable notice of a covered claim where possible.
You may not settle a claim in a way that admits fault by Gordon or imposes obligations on Gordon without Gordon’s written consent.
This section does not require you to indemnify Gordon for claims caused solely by Gordon’s fraud or wilful misconduct.
37. Disputes and Informal Resolution
Before starting formal legal proceedings, you and Gordon agree to make a reasonable effort to resolve the dispute informally.
To notify Gordon of a dispute, email:

- Your Gordon account email address.
- A description of the issue.
- The outcome you are requesting.
- Relevant dates, charges, articles, or account details.
Gordon will review the issue and attempt to respond within a reasonable period.
Nothing in this section prevents either party from seeking urgent relief where necessary to protect accounts, systems, intellectual property, confidential information, or legal rights.
38. Governing Law
These Terms of Service are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.
Subject to any mandatory right you may have under applicable consumer law, disputes relating to these Terms or Gordon will be brought before the courts located in Toronto, Ontario.
Nothing in these Terms removes a consumer right or remedy that cannot legally be waived.
39. Electronic Agreement and Communications
You agree that these Terms form an electronic agreement.
You consent to receive notices and communications electronically, including by:
- Email.
- Account notifications.
- Dashboard messages.
- Notices posted on usegordon.com.
- Checkout or subscription notices.
Electronic communications satisfy any legal requirement that a communication be provided in writing, to the extent permitted by law.
You are responsible for keeping your account email address current and checking Gordon communications.
40. Changes to These Terms
Gordon may update these Terms to reflect:
- New features.
- Changes to the Service.
- Changes to plans or billing.
- Changes to service providers.
- Security requirements.
- Legal or regulatory developments.
- Improvements to clarity.
The updated Terms will be posted on Gordon with a revised “Last updated” date.
Where reasonably practical, Gordon will provide additional notice of material changes through email, the dashboard, or the website.
If a change materially affects an existing paid subscription, the notice may state when the change will apply.
If you do not agree to an updated version, you must stop using Gordon and cancel your subscription before the updated Terms take effect.
Your continued use of Gordon after updated Terms take effect means you accept the updated Terms, subject to any consent requirements under applicable law.
41. Assignment
You may not assign or transfer your account, subscription, or rights under these Terms without Gordon’s written consent.
Gordon may assign these Terms as part of a merger, acquisition, financing, reorganization, sale of assets, transfer of the Service, or similar business transaction.
Any permitted successor will remain subject to the obligations applicable to the transferred agreement.
42. Force Majeure
Gordon will not be responsible for delay or failure caused by events outside Gordon’s reasonable control.
These events may include:
- Internet outages.
- Power failures.
- Hosting failures.
- Cloud-service outages.
- WordPress outages.
- AI-provider outages.
- Payment-network failures.
- Cyberattacks.
- Natural disasters.
- Fires.
- Floods.
- Severe weather.
- Epidemics or public-health emergencies.
- Labour disputes.
- Government action.
- War.
- Terrorism.
- Civil unrest.
- Changes in law.
- Failures of telecommunications or infrastructure.
Gordon will use reasonable efforts to restore affected services where practical.
43. Severability
If a court determines that a provision of these Terms is invalid, unlawful, or unenforceable, that provision will be limited or modified only to the minimum extent necessary.
The remaining provisions will continue in effect.
44. No Waiver
If Gordon does not enforce a provision of these Terms immediately, that does not waive Gordon’s right to enforce it later.
A waiver is effective only if provided in writing by Gordon.
45. Entire Agreement
These Terms of Service, Gordon’s Privacy Policy, the plan information displayed during checkout, and any additional written terms presented for a specific feature form the entire agreement between you and Gordon regarding the Service.
They replace prior discussions, representations, or agreements concerning the same subject.
If there is a conflict:
- Specific written terms presented for a feature or purchase control for that feature or purchase.
- The plan and checkout information control regarding price, billing period, and included allowances.
- These Terms control regarding general use of the Service.
